General Terms
1. Scope
These general terms and conditions of sale apply to all orders placed via this webshop. By placing an order, the customer expressly acknowledges having read and fully accepted these conditions. Any general or specific conditions of the customer are expressly excluded. Any deviation from these conditions is only valid if it has been confirmed in advance and in writing by Cottonic. If any provision is found to be invalid or unenforceable, this shall not affect the validity of the remaining provisions.
2. Order and confirmation
An order is considered final after confirmation via the webshop. Cottonic reserves the right to refuse, suspend or cancel an order in cases including, but not limited to, incomplete or incorrect information, supply issues, or previous disputes relating to payments. The customer undertakes to provide all necessary information in a timely and accurate manner in order to enable correct and timely execution of the order.
3. Prices
All prices are expressed in euros and exclude VAT as indicated. Any additional costs, including transport costs or other charges, are stated separately. Cottonic reserves the right to adjust its prices in the event of changes in external cost factors, such as raw material prices or supplier conditions.
4. Payment
Payment shall be made according to the available payment methods and within 15 days. In the event of late payment, default interest of 1% per month shall be due automatically and without prior notice of default. In the event of non-payment, Cottonic reserves the right to suspend or cancel the execution of the order.
5. Personalisation
The products offered for personalisation are customised according to the customer’s specifications. The customer is solely responsible for the accuracy of the data provided, including files, colours and texts. Minor variations in colour and quantity are possible and accepted, with a tolerance of approximately five percent. If no proof has been requested or approved, the customer accepts the final result as delivered. The seller is not responsible for errors in the designs or files provided.
6. Delivery and delivery time
Delivery is made to the address provided by the customer. The stated delivery times are indicative and depend on product availability, the nature of the personalisation and the production schedule. Unless otherwise stated, the indicative delivery time is three to five working days. For personalised items, Cottonic reserves the right to deliver within approximately two to three weeks. In the event of delays, including due to stock shortages or supplier delays, the delivery time shall be automatically extended. Such circumstances do not entitle the customer to cancel the order or to any compensation. Changes to the order may also result in a revision of the delivery time.
7. Availability and stock shortages
All orders are executed subject to product availability. If a product is temporarily unavailable, Cottonic reserves the right to postpone delivery, propose an equivalent alternative or partially deliver the order. The customer will be informed accordingly. Such situations do not give rise to any compensation.
8. Return policy
As most products are custom-made and/or personalised, the right of withdrawal does not apply to these products. For all non-textile gadgets, returns are not possible. Returns are also not possible for personalised items that include, in addition to the Baloise logo, a personal logo.
Returns are only accepted if the delivered product is defective, was damaged upon delivery or does not conform to the order. In such cases, the customer must report any complaint in writing within forty-eight hours after delivery, including a clear description of the problem and supporting evidence such as photos.
For clothing items with sizes, one return per order is allowed. This return is entirely at the cost and responsibility of the customer. If the item is reshipped after return, the transport costs for this reshipment will also be charged to the customer.
If the complaint is found to be justified, Cottonic will, at its discretion, replace the product or refund the purchase amount. Unless the defect is demonstrably attributable to Cottonic, return costs shall always be borne by the customer.
Returns without prior written approval will not be accepted under any circumstances.
To avoid mistakes and unnecessary returns, we recommend checking the following before completing the order:
- Carefully check the selected quantities and variants (such as size, colour and model).
- In case of cobranding: verify all personalisation details, including texts, logos and spelling. Confirm that the provided design is correct and complete.
- Check that the delivery address is correct and complete.
- Check the expected delivery time, especially for personalised products.
9. Complaints and liability
Visible defects must be reported within forty-eight hours after delivery. Hidden defects must be reported within a reasonable time after discovery and at the latest within one month after delivery. Filing a complaint does not suspend the customer’s payment obligations. Cottonic’s liability is in all cases limited to the value of the delivered products. Cottonic cannot be held liable for indirect or consequential damages, nor for errors resulting from information provided by the customer.
10. Retention of title
The delivered products remain the property of Cottonic until full payment of the amounts due, including any costs and interest. Until that time, the customer is not permitted to sell, pledge or otherwise encumber the products.
11. Force majeure
In the event of force majeure, including but not limited to production interruptions, transport issues, strikes, pandemics or supply problems with third parties, Cottonic has the right to suspend or terminate the performance of the agreement without being liable for any compensation.
12. Cancellation
Cancellations of orders are in principle not possible. Once placed, an order is considered final and cannot be cancelled.
In the event of exceptional circumstances or force majeure, the customer may contact Cottonic to explain the situation. In such cases, it will be jointly assessed whether a solution is still possible.
13. Privacy
Cottonic processes personal data in accordance with applicable data protection legislation. The processing of personal data is further explained in the privacy policy available on the website.
14. Applicable law and competent court
These general terms and conditions of sale are governed by Belgian law. All disputes arising from or in connection with these conditions fall under the exclusive jurisdiction of the courts of Antwerp.
