TERMS AND CONDITIONS OF SALES
Standard terms of sale
1. General
These general terms and conditions apply to all orders placed through this McDonald’s webshop, managed by Cottonic BV, Autolei 350, 2160 Wommelgem (CBE 0862.369.986).
By placing an order, the Customer accepts these terms and expressly waives their own general or special terms. Deviations are only valid if confirmed in advance and in writing by Cottonic BV. The invalidity of one clause does not affect the validity of the remaining provisions.
2. Intellectual Property & Brand Use
Cottonic BV retains all copyrights and intellectual property rights on designs, documents, proofs, images and other materials. Reproduction or distribution is only permitted with prior written consent.
The Customer grants Cottonic BV the right to use the McDonald’s brand identity (logos, visual elements, colour codes, guidelines) for the execution of this project, without any transfer of intellectual property rights.
All goods remain the property of Cottonic BV until full payment, even if already processed or resold.
3. Quotations & Orders
Quotations are non‑binding and valid for the period indicated, or for a maximum of one month if no period is specified.
An order becomes binding as soon as Cottonic BV receives it by email or via the webshop. Cottonic BV may refuse an order in case of supply issues, unclear information, unethical requests, or outstanding payment disputes.
4. Prices
All prices are shown in euros.
- B2B (McDonald’s restaurants): prices excluding VAT.
Packaging, delivery and import costs are listed separately. Cottonic BV may adjust prices in case of fluctuations in raw material costs, fuel costs, wages or supplier prices, with prior notice.
5. Payment
Invoices are payable according to the terms stated and no later than 30 days after the order date.
In case of non‑payment, all outstanding amounts become immediately due and deliveries are suspended or cancelled. All delivered goods remain the property of Cottonic BV until full payment.
6. Cancellation
Orders cannot be cancelled or modified after confirmation, unless with written consent from Cottonic BV. If applicable, costs may be charged.
7. Delivery & Risk
Delivery times are indicative and agreed with the McDonald’s head office. Risk transfers to the Customer upon receipt of the goods. Delays do not entitle the Customer to compensation or cancellation.
Cottonic BV may deliver orders in partial shipments at no extra cost.
8. Complaints
Complaints regarding visible defects or errors must be reported in writing within 48 hours after delivery to info@cottonic.be info@cottonic.be, including photos and the order number. After this period, the delivery is considered definitively accepted. Delivered goods are never taken back. Returns are not allowed. Only in cases of serious damage (product unusable) may the Customer file a complaint.
Complaints regarding hidden defects must be reported in writing within 5 working days after discovery.
9. Liability
Cottonic BV’s liability is limited to the value of the order. Cottonic BV is only bound by a best‑efforts obligation. Cottonic BV is not liable for indirect damage, consequential loss, loss of profit or reputational damage. Cottonic BV is not liable for technical errors, temporary unavailability of the webshop or inaccuracies in product information or pricing.
10. Privacy
Cottonic BV handles all personal data provided by the Customer confidentially and will not share this data with third parties. The data is used solely for the execution of the agreement and administrative follow‑up. If necessary, Cottonic BV may use the contact details to reach the designated contact person for questions, remarks or practical coordination.
11. Personalised Products
Products that are printed, embroidered or otherwise personalised are not subject to the right of withdrawal. Colour variations and quantity deviations within a tolerance of ±5% are accepted.
